CullBench End User License Terms

These terms apply to the perpetual CullBench macOS license sold through cullbench.com and Paddle.

Effective: July 12, 2026

1. Operator and scope

CullBench is operated by independent developer Qiang Fu under the CullBench brand. The App may display its FramePick name during the brand transition. These terms govern the software license and product support; payment, taxes, receipts, and transaction refunds are also governed by the Paddle Buyer Terms.

2. License grant

After payment, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right for personal or internal business use. One license may be active on up to two Macs controlled by the same buyer.

  • You may use purchased and entitled versions perpetually.
  • The launch perpetual license includes all 1.x features and maintenance updates; 2.x or later major versions are not promised.
  • You may keep reasonable installation and disaster-recovery backups, but may not distribute them.

3. Restrictions

  • Do not sell, rent, share, or publicly distribute license keys or App packages.
  • Do not bypass activation, device limits, signatures, notarization, updates, or other security controls.
  • Except where applicable law expressly allows, do not decompile, disassemble, or extract protected models or keys.
  • Do not use the software to violate privacy, intellectual property, or other rights, or process photos you may not access.

4. Local AI and your decisions

CullBench organizes photos using visual and time signals but does not guarantee that grouping, recommendations, quality hints, or format detection are always correct. You must review final Picks, ratings, exports, and any deletion, and keep appropriate backups of originals. The software does not automatically delete originals for you.

5. Systems, updates, and third-party components

The software requires the published macOS, hardware, and storage conditions. Changes to operating systems, camera formats, or third-party components may affect compatibility. We will reasonably maintain 1.x but cannot promise every future system or camera. Open-source and third-party components remain under their own licenses.

6. Payment and Merchant of Record

Paddle is Merchant of Record and manages payment methods, applicable taxes, receipts, and transaction support. CullBench supplies the software, license, download, and product support. Displayed prices may vary by region, currency, tax, and Paddle Checkout; the final total shown before payment is the transaction price.

7. Refund, revocation, and termination

You may request a refund within 14 days under the Refund Policy, and non-waivable consumer rights always prevail. Authorization ends after a refund, chargeback, fraud, material breach, or license revocation. The service may block new claim, activation, restore, and update operations. Termination does not authorize us to delete photos or review state on your Mac.

8. Warranty and liability

To the extent allowed by law, the software is provided as-is without a promise that it is uninterrupted, error-free, or fit for a particular shoot. These terms do not exclude warranties, consumer rights, fraud liability, or personal-injury liability that law does not permit us to exclude.

Where lawful, our aggregate liability relating to the software is limited to the amount actually paid for the license giving rise to the claim. We are not liable for missing backups, incorrect culling, indirect loss, lost profits, or business interruption.

9. Changes and contact

We will give advance notice of changes materially adverse to existing purchases. Contact support@cullbench.com for license or support questions.
